1. Acceptance of these terms
By using the TCS Accounting website, client portal or by engaging us for professional services, you agree to these Terms of Service. If you do not agree, please do not use our services.
2. About us
TCS Accounting is a tax practitioner and accounting practice operating from 47 Redwood Place, Moreleta Park, Pretoria, 0044. Engagements for professional services are governed by a separate written engagement letter signed by both parties; these Terms apply in addition to and not in place of that letter.
3. Use of the website and portal
- You must provide accurate information when creating a client portal account.
- You are responsible for keeping your login credentials secure.
- You may not attempt to access another user's account or our systems without authorisation.
- You may not upload unlawful, infringing or malicious content.
- We may suspend access if we reasonably believe these terms have been breached.
4. Professional services
The scope, fees, deliverables and timeline of any professional engagement are set out in a separate engagement letter. Until such a letter is signed, no client relationship is formed and no advice we publish on the website or in correspondence may be relied on as personal tax, accounting or legal advice.
5. Fees and payment
Fees for professional services are billed in accordance with the engagement letter. Invoices are payable within 30 days of issue unless otherwise agreed. Late payment may attract interest at the prescribed rate under the Prescribed Rate of Interest Act.
6. Client responsibilities
- Provide complete and accurate financial information on time.
- Authorise us in writing where third-party access (e.g. SARS eFiling) is needed.
- Notify us promptly of any material change in your circumstances.
- Retain your own copies of documents — while we maintain backups, primary responsibility for record-keeping under the Tax Administration Act rests with you.
7. Confidentiality
We treat all client information as strictly confidential and only disclose it as required by law, with your express instruction, or to regulators (SARS, CIPC, FIC) acting within their statutory mandate.
8. Limitation of liability
To the extent permitted by law, our liability for any claim arising out of or in connection with the services is limited to the fees paid by you for the specific engagement giving rise to the claim. We are not liable for indirect, special or consequential losses. Nothing in these Terms limits liability that cannot be limited by law (e.g. for fraud or wilful misconduct).
9. Intellectual property
All content on this website — text, images, branding — is owned by TCS Accounting or licensed to us. You may not reproduce or republish it without our written permission. Working papers and templates we develop remain our property; deliverables specifically created for you and identified as such in the engagement letter become yours upon payment.
10. Privacy and POPIA
Personal information is handled in terms of our Privacy Policy and the Protection of Personal Information Act, 4 of 2013. See our PAIA Manual for information access requests.
11. Termination
Either party may terminate an engagement in accordance with the engagement letter. Upon termination, fees for work performed remain due, and we will return your records once outstanding fees have been settled, subject to any lien we are entitled to exercise.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of our services after an update constitutes acceptance of the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be referred to mediation in the first instance, failing which to the Magistrates' Court for the district of Pretoria, or the High Court of South Africa, Gauteng Division.
